Didn't know there was a gay monopoly. How about that? They will theme this game into anything. Anyway, whether gay, simpsons, or standard monopoly, I really do not like the game. It takes for ever, you randomly go around the board and lose money, everybody has house rules, I don't know, I wish I had the time back for the games that I have played. One of the worst gifts I got was Star Wars monopoly. It has been played once.

So very true. Should this measure actually pass (and it's a close race), the ACLU will have an injunction on the doorsteps of State Capital Building in Sacramento before the dawn.

I don't understand how they'll contest this Amendment. It is a California State Constutional Amendment, is it not?

Will there not have to be another amendment to the CA State Constitution repealing this amendment (ala prohibition repeal amendment in the federal constitution?).

In Missouri our State Constitution was amended such that marriage was defined as being between a man and woman.

The only way that is getting repealed is through another amendment.

Otherwise a Federal Court is going to have to find that such an amendment to a State's Constitution goes against the Federal Constitution and is therefore (federally) Unconstitutional.

But until that happens no litigation, at least give my layman's understanding of constitutional law, is going to stop these amendments from taking force.

This tactic is called Super Legislation. Why is it a constitutional amendment instead of a regular law? So it's hard to get rid of.

Disgusting tactic employed by states.

The state appeals process can tie things up in the courts. At least in California, until it is adjudicated, it cannot be enforced.

I agree, it's a very distasteful way to impose morality on people. And both sides of any argument use the tactic all of the time up in Sac-town.

It is my understanding that it was originally a duly enacted state statute, approved by the voters of California, which was then nullified by a State court; hence the consitutional amendment approach.
