My understanding on reading this is that no one has been convicted, and that this hearing assumed (and did not conclude) all allegations were true. The issue before them was whether, if the allegations were all true, they would be moot because no remedy was sought other than the cessation of the relevant programs. The court appears to have found that whether these procedures have stopped should be independently confirmed.

Do you read any of that differently than I do?

This decision is based on assuming everything alleged in the complaint, without requiring the evidence to be presented. It's just a procedural step in a long legal process.

I can't exactly tell if you're serious. This court ruling points out that the IG report found some serious misconduct at the IRS. This is not news, the IG report has been public for years (it was written in 2013) and we're all familiar with it already. The ruling doesn't say anything new about the IRS, it just goes to the question of whether there should be a trial and potential remedies over the misconduct that everyone has already agreed occurred.

Bingo.

The decision of he Appeals Court merely concluded that dismissal of the equity claims on procedural grounds was unwarranted and they essentially returned the case to the trial court for a determination of the issues on the facts. In other words this was a strictly procedural determination.

The case also does not speak to whether the tax exempt status of the the organizations was legitimate in the first instance

You asked if anyone from the IRS will suffer consequences from a hearing which neither found nor even sought any evidence of wrongdoing on the part of the IRS (or anyone else). Did you think that was where the goalpost ought to be?

I don't believe anyone said that. Of course individuals at the IRS made mistakes and applied their procedures unfairly and inconsistently. That's been clear at least since the 2013 IG report that the court just cited. The court didn't say anything new, they just repeated what's already in the report.
