I'm currently playing a game of Free at Last.
My opponent's segregationist strategy is to abandon 2 of the three cities in each state in order to hold out in just one.
The idea is that if the Civil Rights player can't win a battle (since there's no opposition) then they can't gain anything on the freedom track or free any of these abandoned cities from segregation (V,S,A).
Is this a viable strategy or are we playing wrong?

That is a valid strategy. As the civil rights player I like to build stacks of 10 before attacking. The segregationist can counter it by stacking in the same city, but your recruitment rate is faster. He has the attrition advantage though.
Edit: I misunderstood the question. The Civil Rights player can certainly make a protest against a defenseless City and win. You get the Freedom Marker. So retreating from a City to avoid losing battles is not really effective.
