Hi. If my opponent and I both have one or more palace guards, and I play Clerical Error to get one of her palace guards, could she get one of my other palace guards, or would this be considered "the same card"? Thanks in advance!

As I understand the rules, you could end up swapping palace guards. Multiple copies do not make them the same card for matters of exchanges.

Short answer: Yes she could take the other palace guard.

I have a chocolate chip cookie and you have no cookies. You play clerical error and take my cookie. I can't the cookie back as it is the "same cookie" that you took.

I have a chocolate chip cookie and you have a chocolate chip cookie. You play clerical error and take my cookie. Are you thinking that somehow your cookie and my former cookie are now the "same cookie" so that I can't take your original cookie? Gimme that cookie!
