Rules, page 7

The defender may not try to escape during the escape phase, only the attacker may attempt to escape. If a player that is being attacked by another player successfully escapes, he may move one space in any direction

Obviously he means only the defender may attempt to escape, right?

No, it is correct. Attacker and defender are defined on a turn base. The player who does the attack roll (one of your 3 rolls is the attack roll) is the attacker, the other is the defender. On the next combat turn attacker and defender change.
The player being attacked is the on, who was first on the space.

Re: Battle between Heroes - possible rule error?
No, I think that's right, attacker may try to escape. Point being that the initial attacker (usually the stronger) doesn't want to escape on the first turn, but as the roles are swapped for the second round of combat (initial defender is now attacker), if outmatched, probably wants to try and escape.

FFG has PvP example:

http://www.fantasyflightgames.com/edge_news.asp?eidn=105

"The 1st Combat Round: We now enter normal combat. As the defender, Mad Carthos may not try to escape, much as he’d like to. Mordrog could attempt to escape, but he’s a raging homicidal lunatic who wants Mad Carthos’s gold, so he won’t."
