I can't work out how:

Two Rooms and a Bang!

Is allowed ????

I'm sure you can copy two games, squeeze them into one, and re theme/name it

But to call the game both the other games names, and to say (in the description you have copied both of them), this game is X and Y made into one game... That has to be against the rules/laws of most countries

Anyway please feel free to back my new KS campaigns for:

Ticket to Catan
Carcassonne City
Pandemoretto
Dead of Winter: A Crosswords Game
Race for the Twilight

Etc

As I said

But they use the name of both games in title and description

That's what I'm talking about

Generic names aren't copyrighted, either ...

While "Catan" may be copyrighted, none of the words "two rooms and a bang" can be copyrighted at all ...

Kind regards,
Kai

I'm wondering which of the words in "two rooms and a bang" you think are copyrighted.

Are they trademarked? Is the trademark owners sending a Cease and Desist?

Civil matters aren't dealt with as legal and illegal, but damages in the courts.

You're too late.

(there used to be some mock board game cover illustrations in posts in that list, but I kept my illustrations with Apple's .mac service, and they disappeared when Apple stopped it. So now you can admire some awesome white question marks on a blue background instead)

I think it would fall under passing off/misleading

Two rooms and a bang!

seems too close

Ok - you can't trademark a name

It still seems mucho shady

sometimes, it may be useful to have 'scary' letters sent to a new competitor to get them to desist in a blatant (though 'legal') copy-job. But they probably know how far they can go anyway and will ignore the threat. A tort suit might be possible, but is it worth the risk?

But usually, it ends up with the competitor getting free publicity and enjoying more sales than if you ignored them.

if you are a big enough and 'important' enough publisher/distributor - you could threaten to pull ALL your titles from any store selling the copied version, depending of course on the prevailing laws about such actions.

If the publisher of Two Rooms and a Boom had FFG's lawyers this would be dealt with pretty swiftly.

Yup, right after when they've dealt with the producers of those Chinese knock-off copies of their own games - on Saint Glinglin's Day.

Well, ask anyone who's tried to make a game with "Arkham*" or "Eldritch" in the title.

*Except for those pesky Batman licenses they won't touch.

Actually you can trademark a name. Overwatch the new game from Valve just got denied a trademark this year for the name Overwatch because someone else already has it.

True, but that's really rare. The first time I remember it happening was when James Clavell's lawyers forced Milton Bradley to change 'Shogun' to 'Samurai Swords'. Shogun was a major property as both a book and a motion picture, so they were in a position to aggressively defend what they saw as their intellectual property. The word shogun was and had been in common use, and MB's lawyers might have won had they the resources and inclination to engage in a protracted legal struggle, but (I assume) decided it simply wasn't worth it.

Despite such instances of legal action, we do still see names used repeatedly, even names representing major franchises:

War of the Ring
War of the Ring
War of the Ring (First Edition)
War of the Ring (Second Edition)
etc.

While it's not "illegal" it would be an easy lawsuit if a judge is convinced that the name and contents are so similar that it would confuse customers. And really, it's no contest considering that's the game's description.

But nobody cares because Two Rooms and a Bang isn't being distributed and as far as I know doesn't really exist.

Catan + Splendor = Candor! A game in which the players openly and honestly discuss their plans during play.

Similar to the movie industry. Take a look at the title and DVD artwork for just about any movie that C. Thomas Howell has appeared in since the 1990s and you'll see that a more famous movie has clearly been ripped off. It's the way of the world, I tell ya!

If I saw the Two Rooms and a Bang! I would assume it was either an official mash up like One Night Revolution was going to be (before the dropped "Resistance" from the title), or a dodgy knock off. from reading the description it looks like it's sufficiently different to Two Rooms and a Boom, though I don't think choosing such a similar name is a good thing.
