Suit Seeks $25M Damages For Islamophobic Bullying of Special-Needs 12-Year-Old

Islip Patch reports on a federal court lawsuit filed Monday by the parents of a 12-year old Muslim special needs student alleging that he was the victim of Islamophobic harassment by fellow-students and school personnel of thhttp://nypost.com/2016/08/16/muslim-boy-claims-school-forced... East Islip, New York School District. According to the complaint, Nashwan Uppal (whose family is from Pakistan) was bullied by a group of students who called him a terrorist and asked him what he was going to blow up next. Thinking "terrorist" meant "tourist," Uppal eventually said he was going to blow up the fence. The next day Uppal was interrogated by the principal and assistant principal who searched his backpack and locker and demanded that he write a confession that he was part of ISIS. Subsequently he was questioned by police while his mother waited outside the school. New York Post adds:

Officials eventually let [Uppal] call his mother, Nubaisha Amar, who was told her son had pledged allegiance to ISIS and was going to blow up the school. Cops escorted mother and son back to their home before searching the entire house and concluding he was no threat. But Uppal was suspended for a week for “criminal activity.”
The suit seeks $25 million in damages for severe and extreme emotional distress.

I hope this goes to court if true. A hushup settlement will make it go away from the public eye, and if it's true that's a level of criminal negligence that should be routed out severely.

They will be along shortly to tell us that some pretty legit website (Info Battles? Info Combat? Something like that) says the kid's father is actually heir to throne of some Middle Eastern nation or wannabe president or some such. Also the same site will show that ISIS has been into blowing up school fences. It's number three on their list of priorities. So obvi, this kid is the real thing. Oh, and tourist will be shown to be code for ISIS attack.

The next day, Uppal was pulled from gym class by Superintendent John Dolan, Principal Mark Bernard and Assistant Principal Jason Stanton, and interrogated, the suit claims.

“Stanton repeatedly asked Nashwan if he was a terrorist, and if he made bombs in his house,” the complaint says. When he said no, an increasingly irate Stanton allegedly bellowed, “Don’t lie to us!”

A trembling Uppal was forced to write a confession saying he was “part of ISIS, knew how to make bombs, that he had bombs in his house, and that he was going to blow up the school fence,” the suit says.



Honestly, this passes the smell test for you?! The Daily Mail says that the boy refused to write "the confession."

Do you want to bet that the actual instruction given was something like, write down in your own words what happened yesterday with those boys.

The boy was suspended for five days because he actually did say he'd blow up the school fence. I think the bullies ought to have been suspended as well, if they haven't actually already been.

And why should he have to write anything down ? It's not a requirement. And if he was asked to write down his version of the events the other boys should have been asked to as well. How much do you want to bet that didnt happen and that he was the only person asked to write something down at all.

Also, the interrogation seems to have reached the point where they were essentially accusing him of making bombs at his home. If you're going to accuse a special needs minor of a crime then you should probably include his parent(s) in the meeting rather than have them wait outside as the article states was done.

And what exactly was his criminal activity again for which he was suspended for a week ?

One thing I do know is schools handle bullying extremely poorly. I hope more lawsuits are brought against schools until they take it seriously and deal with it better. I believe every classroom should have a camera in it as well as cameras in the halls and cafeteria. Children are our most precious commodity but yet we don't monitor them in school or the people who teach them.

I do love the sky high numbers for US claims given the punitive elements.

Having the whole family taken out with machine guns should get you 25 million.

Because a special-needs kid said something he didn't understand while under intense interrogation without a sympathetic adult to explain what was happening, he deserves to be suspended?

30 day suspension might be mandatory under the law for bomb threats period. And no one is questioning that he made a bomb threat. The law likely doesn't make the distinction between a bomb threat from a "normal" kid and a developmentally challenged kid. Frankly I'd be more worried about the kid who doesn't get along with others more than the kid who has everything going righ.

Just another case of the law tying the hands of the administrators and people going ape-shit over some shitty reporter's sensational version of the story.

And about the "confession", for fucks sake, haven't you ever been pulled over on a US highway before? After the cop gives you the citation, you either sign it, or the cop notes that you refused to sign. The signature isn't an admission of guilt, it is only proof that you were presented with the citation by the officer in question at the time and location cited.

Yet again folks on the Internet going stupid after reading an article by a shitty journalist, that doesn't even have a copy of the "confession" for us to weigh.

Actually, if you want to play that card Jeremy... Islip is two towns over from me, and is a local Republican stronghold. Elected govt is Republican top to bottom in Islip.
