ok when playing with less then 4 players shouldnt you reduce the number of open tiles to 4 for 3 and 3 for 2 playerrs? or did i overlook some important twist in the rules why 5 open tiles are necessary? ... thanks for explanation...

Official rule = no. Always 5 tiles.

It'd make little difference, since there are always N tiles chosen per round (and thus N new tiles drawn each round), plus 1 when someone plays the "9" card (N = number of players).
3 players see one extra tile (in the whole game!) with the official rules (VS your version).
2 players see two extra tile (in the whole game!) with the official rules (VS your version).
Probably such minimal extra variety was not deemed worthy of an extra rule. Of course you should feel free to apply any house rule you (and your mates) find appealing.
