The only good news is that Justice can't actually make law. If the statute allows this type of loophole, then Congress has the authority to close this loophole. Moreover, this can be challenged in the courts.

However, my guess is that people will just let this slide. I mean, Kim Kardashian got divorced after only HOW LONG???? What is this country coming too??????

Kim Kardashian got divorced? I didn't even know she was married. Still probably couldn't pick out of a line up.

But thats probably cause I get most of my news from RSP. Unfair and balanced like a 3-legged chair. But generally sticking to relatively interesting stuff.

He might go down in history as the worst president in terms of civil liberties. I think it amazing how everyone is duped by him. The Dems think he's doing a good job and turn a blind eye to shit like this and the RNC - NRA and Teabaggers think he's anti-gun, weak on immigration and a Muslim when he has only singed pro-gun legislation, deported more people than Bush and has started more wars and commits due-process free executions on US citizens that are "terrorists". He's probably the worst president ever... but given the trend I am sure I would have said the same thing if zombie-man and voodoo lady won.

Not much to add, but I wanted to do more than thumb the OP to establish my fairness cred. I get sort of annoyed at how some conservative sources suggest that any failure of total, immediate transparency is a sign that Obama's totally full of crap on the issue, since it's obviously possible to do better than has been done before without being perfect. However, on my admittedly superficial reading, this proposal is crap and should get the administration substantial criticism from all over the political spectrum.

Yes, this proposal is evil and stupid. No, it doesn't invalidate Obama's Presidency or its many positive accomplishments. And anyone who thinks any of the 6 most recent administrations are the 'worst President ever' needs remedial history lessons.

I meant it only in the degrading of civil liberties. Increased Executive Powers, The Patriot Act, Racial profiling and No Due Process Assassinations of Citizens are several steps backwards not to mention potential impeachable constitutional violations, especially with the latter.

Yeah, the proposal is bullshit and, as I was hearing from an ACLU rep on NPR the other day, it's not even necessary. There's already a rule letting the government say "We will not confirm or deny the existence of these records" under particular circumstances; it's easy enough for them to say "We believe that if the records you requested exist, they would [fit the criteria], so we are not going to process your request (i.e., we're not even going to look for them)."

My entirely inexpert guess is that this one won't actually survive.

EDIT: I do have to say, however, that if the DOJ has told the President that this proposed rule passes Constitutional muster - and who know what those jackasses have told him - it doesn't actually contradict the campaign rhetoric BJ quoted. (In fact, since the government undoubtedly already lies in response to some FOIA requests, having a rule on the books that authorizes the behavior could be viewed as more transparent - "OK, we're telling you up front that we might lie to you about your requests" is not transparent as to the request, but it is pretty transparent as to how DOJ is going to operate.)

The proposal is dead, but it's apparently a sort of reverse zombie--though it was killed before it came into (official) existence, it was acting sort of alive long before that.

It's a confused metaphor.

By increasing the role of the federal government, and resolving the war in a way that was favorable to the north, what Lincoln did was to pasteurize the US, making sure it'd not have a very early expiration date.

A country with wide legislative and economic variations, like the US was back then, just can't share the same currency without major economic problems. In a way, it's not all that different than the eurozone's current economic situation.

Without the changes that occurred after the civil war, I'd expect the US would have just had one civil war after another every 100 years or so.
