Whenever I hear or read the word 'games' followed immediately by the word 'workshop', I always say to myself silently, "Fuck you guys. Seriously."

With the caveat that if the word 'design' is in the middle,
it is actually likely to be a reasonable product.

This sucks. I just sent a brief but honest email to their "customer service" saying that I was simply disheartened that they would try and own "space marine," a title that belongs to science fiction and its enthusiasts, NOT Games Workshop.

I know, I know, it won't get anything done, but neither will sitting by and doing nothing.

I may start "Workshop of Games" and make a game called Warbluntweapon with my Forest Elves and Britonian knights and see how long I last before they sue me so hard I have to give them my dog and kiss the Emperor's Throne.

GW is not claiming a right to 'space marines' as in copyright law; they are defending a trade mark in terms of "dress" that is a material aspect of their branding; even if they don't have it registered, their actions to assert the value create a strong precedent.

Can you trademark a turn of speech that has been in the public domain since at least 1932? This is extortion by an 800b gorilla, plain and simple. And given that the EFF and writers like Neil Gaiman and John Scalzi are now up in arms, it's gonna backfire. Not that GW hasn't tried stirring the pot before. Litigious bastards.

I miss the good old days of GW, when they sold other people's games, miniatures, and such.

When they sold video games, RPGs, board games ... absolutely everything game-related, regardless of who made it.

They were my source for Infocom games, for one thing.

Then, after they had that orange sticker sale in the summer of '87, it all started sliding downhill.

*sigh*

Still, we should have known how they'd end up after the sneak tactics that they used to destroy Adventurer magazine.

Look, I don't know anything about legal mumbo jumbo, but I know a guy trying to publish a work of fiction with "space marine" in the title shouldn't get treated like this by a company who is utterly dependent upon fans of science fiction, fans who know that said company "borrowed" the term in the first place.

They're biting the hands that feed them, and I hope one day people will wake up so that their "it's just good business" attitude will come back to bite them on the a$$

Part of the problem is that their business model IS to bite the hands that FED them. They market primarily to new customers and do not really care about long term customers.

Once anyone has known them long enough to know better, they either have become rabid fanboys who will buy regardless, or have progressed beyond where GW cares about their opinions.

Luckily the call for pro bono help has gone out on Popehat. I would anticipate this bogus claim will vanish in short order.

For the record, I'm nothing to do with Popehat, but would recommend it for a good read.

I know very little about Games Workshop and their claim, but MCAH makes this claim, "I want someone to save all space marines for the genre I grew up reading. I want there to be a world where Heinlein and E.E. Smith’s space marines can live alongside mine and everyone else’s..." So I got to thinking, is the term "space marine" in any science fiction book you can name? I really don't think it's used in Heinlein.
